Second, immigration regulations and policies issued during four stages of the history of international migration are studied: 1) from the Late Nineteenth Century to 1914, when the first immigration regulations were introduced; 2) from 1914 to 1945, when immigration controls were systematically established in the majority of states; 3) from 1945 to 1973, when the first significant irregular migration flows and the respective state responses took place; and 4) from mid-1973 to the beginning of the 2000s, when irregular migration consolidated and important regulations to control it were issued. Third, irregular migration policies and social rights which are afforded to irregular migrants in the United Kingdom are explored.

Por ello, cuando las economias locales se desplomaron, las reglas de admision de extranjeros se volvieron mas estrictas, especialmente hacia los pobres. De hecho, los inmigrantes pobres a quienes no se les habia concedido la ciudadania (frecuentemente otorgada despues de diez anos de residencia) podian ser expulsados a la municipalidad de su ultima residencia o, en caso de que esta no pudiera ser determinada, a la del lugar de su nacimiento.

9 De este modo, los extranjeros pobres eran frecuentemente deportados, no por haber entrado, residido o trabajado de forma irregular, sino por no ser economicamente autosuficientes. Con el advenimiento del mercantilismo, las autoridades trataron de restringir los movimientos de personas que no estaban ligadas al mercado formal de trabajo, y que, por tanto, podian evadir el pago de impuestos y la regulacion. Los mendigos eran acusados de evadir el empleo regular y usar ocupaciones itinerantes para cubrir su mendicidad y robar. Algunos migrantes pobres podian burlar las restricciones locales y establecerse sin permiso hasta que eran descubiertos y expulsados. Y los que ya habian sido admitidos, pero no habian obtenido la ciudadania, se abstenian de solicitar ayuda a los gobiernos locales, toda vez que esto podia conllevar su expulsion. Para gitanos y vagabundos esto conllevo la toma de medidas extremas en Alemania, Paises Bajos, Francia y el Reino Unido: su presencia irregular era castigada con el destierro o la muerte. 11 En el siglo XIX, con el fortalecimiento del Estado central, las autonomias locales, a pesar de que siguieron conservando la facultad de ayudar a los pobres, perdieron el poder de decidir sobre la admision de migrantes susceptibles de convertirse en una carga publica.

Hasta mediados del siglo XIX, varios Estados, especialmente de Europa central, prohibieron a sus ciudadanos emigrar sin permiso, pues veian la inmigracion como una perdida de dinero (impuestos) y hombres (soldados), y temian hacerse responsables de la manutencion de la familia dejada atras por estos. 12 Con la industrializacion, y el consecuente crecimiento de las ciudades, los Estados cambiaron su politica mercantilista por una liberal, que vio con buenos ojos, e incluso fomento, los movimientos de personas. En esta etapa, los Estados, con la esperanza de que la mano de obra barata impulsara la economia, permitieron la libre entrada de extranjeros siempre que no se convirtieran en una carga publica ni socavaran los sistemas de servicios sociales. 13 A finales del siglo XIX, y a la par de este proceso de liberalizacion, tuvo lugar un proceso de exclusion de asiaticos, motivado por creencias de inferioridad racial. Los controles migratorios se convirtieron en una herramienta basica de este proceso, y su ejecucion fue el medio fundamental para lograrlo. 18 La importancia que empezo a tener la migracion irregular durante el periodo que transcurrio entre las dos guerras mundiales se explica no solo por la introduccion sistematica de controles y politicas migratorios restrictivos en la mayoria de los Estados, sino tambien por el proteccionismo economico que tuvo lugar durante esos anos. La Gran Depresion de la decada de los treinta resulto en un drastico descenso del comercio internacional, y el desempleo masivo y los gobiernos empezaron a utilizar las repatriaciones forzadas de extranjeros para dar primacia sus trabajadores nacionales. 19 El fin de la Segunda Guerra Mundial conllevo un incremento significativo de la migracion internacional con fines de empleo.

Sin embargo, como existia una alta demanda de mano de obra, en especial no calificada, paises como Francia, Alemania y los Paises Bajos dieron facilidades a estos trabajadores para que regularizaran su situacion una vez que habian encontrado trabajo. Hacia la decada de los setenta se empezo a perfilar una nueva etapa de la migracion internacional hacia los paises altamente desarrollados, cuya caracteristica definitoria fue la proliferacion de la migracion irregular. La crisis del petroleo de mediados de los setenta fue la justificacion para que la mayoria de paises desarrollados pusieran un freno a la migracion internacional. Suspendieron el reclutamiento de trabajadores migrantes e introdujeron politicas y controles migratorios altamente restrictivos dirigidos a evitar nuevas entradas de extranjeros, el aumento de la migracion irregular y el uso de artimanas para evadir las regulaciones. Estas nuevas politicas crearon espacios de ilegalidad que se hicieron notar en los anos siguientes.
